FERC Order No. 717 promulgated new Standards of Conduct regulations for Transmission
Providers. New 18 CFR Section 358.1(a) of the FERC regulations specify that the Standards of
Conduct apply "to any interstate natural gas pipeline that transports natural gas for others pursuant
to subparts B or G of part 284 of this chapter and conducts transmission transactions with an
affiliate that engages in marketing functions." New 18 CFR Section 358.7 requires certain posting
requirements for transmission providers subject to the Standards of Conduct regulations. National
Fuel Gas Supply Corporation and Empire Pipeline, Inc., effective November 1, 2020, have no
affiliates engaged in marketing functions conducting transmission transactions on its pipelines.
Therefore, National Fuel Gas Supply Corporation and Empire Pipeline, Inc. are not currently
subject to the Standards of Conduct and the related posting requirements therein.
